Lindsay Lohan's attorney insists his client doesn't need drug rehabilitation, saying the actress "doesn't have a problem with alochol and drugs."

The actress faces trial on March 18 for allegedly lying to Santa Monica police when she said she was not driving her Porsche during an accident, but despite her legal woes her lawyer is adamant his client doesn't need help in rehab.

At a court hearing last week Mark Heller told a judge that Lohan is in therapy, adding that "this is not what she needs rehab. Lindsay doesn't have a problem with alcohol and drugs. Lindsay's issues are different," according to the LA Times.

The courtroom comment from Heller came amid an embarrassing appearance for the attorney in front of the Los Angeles Superior Court Judge James R. Dabney on Friday, where the New York based lawyer seemed to be told off for not knowing California law.

Lindsay is apparently so fed u! p with her representation that she is reportedly begging her former lawyer Shawn Holley to re-take the case. Insiders have revealed the 'Mean Girls' actress, who suddenly parted ways with the long suffering lawyer last month, pleaded with her to return after Heller failed to delay her court trial.

"Shawn just can't go back, and whoever does take it on, has to know it is a very time-intensive case with lots of different components," an insider told FOX411's Pop Tarts, "Not to mention Lindsay isn't exactly a cooperative client to work with."

Judge Dabney seemed unimpressed that Lindsay had appointed a representative who was not reportedly qualified to practice in California and told Heller to ask his client to reconsider her legal team. "Judges liked Shawn, she doesn't fool around and always makes their process easy," alternative sentencing expert Wendy Feldman told the website.

We wonder what will happen when the case goes to trial?
