Lindsay Lohan got a bit of a legal respite Monday: Prosecutors weren't ready to proceed with a misdemeanor assault charge related to her November nightclub dust-up, and her attorney predicted the case eventually would be dropped.
"We've come forward with a witness who was able to share her personal assessment and witnessing of the event that caused the arrest," attorney Mark Heller told reporters Monday morning, "and it may very well be that this case does not move forward."
Heller told CNN that his client didn't hit anyone but did "verbally request her privacy" in an incident with Palm Beach, Fla., psychic Tiffany Mitchell.
Lohan was not required to be present at the hearing, as there were no charges to plead to. But her mother, Dina Lohan, definitely showed up for an interview with the New York Daily News on Sunday in Long Island, in which she accused ex-husband Michael Lohan of physical abuse and rape, and said that Lindsay's witnessing such abuse is why her daughter is "so screwed up."
Dina brought doctors' and police reports ! with her, the paper said, for an interview reportedly sparked by a 1986 family photo showing her with a black eye, allegedly delivered by Michael.
"When Lindsay saw the photo, she was furious," Dina told the Daily News. She said, 'Tell the world! Talk about it!'"
Dina said Michael was addicted to cocaine and "had a lot of bad stuff going on."
Michael Lohan vigorously denied the accusations, the paper said, and offered different accounts than Dina had to explain the various official reports.
"She's bringing this up now because shes drinking and partying with Lindsay ...," he said, alleging also that Lindsay is Dina's main source of income. "She is the devil."
Lindsay is due in court in L.A. on Jan. 15 regarding an alleged probation violation linked to her June car crash on PCH.
